Client Alert - Tips on Bilski and the USPTO's Guidance on Business Method Patents

Anastasia Zhadina, a partner in CLL’s Patent group, explains and outlines in this Client Alert effective drafting tips for those applying for a business method patent. Ana’s tips are based in part on the USPTO’s recently issued memo to patent examiners entitled “Interim Guidance for Determining Subject Matter Eligibility for Process Claims in View of Bilski v. Kappos,” which contains a checklist to help examiners determine whether a business process claim is eligible for protection.
