Customs Alert - House of Representatives Votes to Repeal Byrd Amendment

Early Friday, November 18, by a 217 to 215 vote, the House of Representatives passed the repeal of the Byrd Amendment as a portion of the Deficit Reduction Act. The matter now goes before the Senate. Currently, the Senate does not have legislation pending which would include the repeal of the Byrd Amendment. As most of you know, the Byrd Amendment was passed as a device to compensate U.S. businesses who were injured as a result of “dumping.” The import community has always taken the position that this was inappropriate. Members of the international trade community also have been critical of the United States because of consequences of the Byrd Amendment’s provisions.
