Client Alert - Louboutin Sees Red - New York Court Refuses to Stop Yves Saint Laurent's Use of Red

Sujata Chaudhri's Client Alert discusses a judgment of the Southern District of New York in a dispute between French designer Christian Louboutin and rival Yves Saint Laurent.  The court denied Louboutin a preliminary injunction against YSL’s use of the color red as part of a monochromatic design in which the shoes are either entirely red or blue or yellow, etc.  the court held that in the field of fashion the color red served a functional purpose.
