Kyle-Beth Hilfer has over thirty years’ experience providing legal counsel to advertising, marketing, promotions, intellectual property, and new media clients. Leveraging her deep understanding of branding, Kyle-Beth ensures regulatory compliance for her clients’ advertising and marketing campaigns. She also helps clients create, monetize, and protect their trademark and copyright portfolios in a global marketplace.

Kyle-Beth counsels across all types of platforms in an ever-changing marketplace, including print, tv, radio, social media, digital, e-commerce, mobile, and virtual reality. She regularly performs advertising copy clearance and claim substantiation review. In addition, Kyle-Beth counsels from concept stage through execution on the legal implications of specific marketing techniques, including sweepstakes and contests, word of mouth marketing, user-generated content, premium offers, rebates, negative option and advance consent marketing, loyalty programs, cause marketing, and native advertising.

Kyle-Beth is a resource for all transactional matters relating to advertising and marketing campaigns.  She drafts all required contracts from agency, marketing services, and influencer contracts to NDA’s, vendor/consulting agreements, and licenses. At the same time, she excels in proactive and early dispute resolution. She also counsels on regulatory investigations, false advertising litigation, and NAD challenges.

  • Advised international sports organization on its advertising initiatives, including copy review, sweepstakes advice, ambush marketing protection, and intellectual property protection.
  • Counseled several national fast causal restaurant chains and a fine dining restaurant group on trademark protection, menu labeling requirements, loyalty programs, influencer programs, coupon programs, sweepstakes, technology vendor and marketing services agreements, native advertising, cause marketing, and data privacy issues.
  • Advised regarding the structure and legality of a cryptocurrency sweepstakes.
  • Counseled international media organization on CAN-SPAM, e-mail marketing campaigns, and native advertising issues.
  • Cleared an e-commerce international sweepstakes in the United States and multiple foreign jurisdictions.
  • Analyzed commercial co-venture laws to determine their applicability to a cause marketing campaign by a significant film studio.
